RIGHT ACTION COMMENTARY
– CALL FOR SUSPENSION OF MINING IN GUATEMALA
This call by the ILO (of the United Nations), for a suspension of mining in Guatemala, is but the most recent public effort to draw critical attention to the environmental and health harms and human rights violations caused by global mining companies in campesino and indigenous communities in Guatemala.
Since 2004, numerous organizations – from community-based groups in mining affected regions of Guatemala, to NGOs, to the United Nations – have been investigating and denouncing the harms and violations caused by companies like Goldcorp Inc, HudBay Minerals, etc.
As yet, to no avail.
Backed by the wealthy and politically powerful sectors inside Guatemala, backed by the Canadian government and corporate-investor sectors in North America, mining companies operate, in Guatemala, with next to complete impunity.
The legal system in Guatemala is weak, at best, and corrupted, at worse, and offers no remedy. In Canada, there is virtually no criminal or civil legislation that can be used to hold companies accountable in Canadian courts.
With gold prices at near all time highs, Goldcorp Inc continues to make extraordinary profits … unchecked.
Rights Action encourages you to act together with mining affected communities in Guatemala in signing this letter (see below) and sending your own letters to Canadian government officials, companies and investors (see below).
The ILO is asking the Government of Guatemala to suspend mining operations while it examines violations of international law. This suspension should be fully supported by Canadians.
Although the operations of Goldcorp’s “Marlin Mine”, and HudBay Mineral’s “Fenix project” also mentioned in the ILO finding, violate international law, there is no enforcement of international law and no support for the rights of poor people, farmers, indigenous or afro-descendent peoples.
In contrast, international “free trade” agreements aggressively protect the “rights” of transnational corporations, like the case of Pacific Rim in El Salvador, where this Canadian gold mining company is demanding over 10 million dollars in “lost profits” that it expected to make because the El Salvadoran government could not make a determination whether or not the project would damage the environment; like the case of the Canadian Blackfire Explorations in Chiapas, Mexico, similarily seeking millions of dollars in “lost profits” compensation.
If the Guatemalan government decides, as is its responsibility, that the mentioned mines are violating international law and the human rights of communities, global companies in Guatemala might then use “free trade” agreements to sue Guatemala for “lost profits”. The government of Guatemala might then be obligated to pay millions of dollars to the mining companies which have already caused irreparable damage to communities, while the communities receive no compensation for the crimes, harms and violations to which they have been subject.
International law demands that mines and other mega “development” projects obtain the “free, prior and informed consent” of indigenous communities they affect. In neither case – Goldcorp’s gold mine; HudBay’s nickel mine – was this informed consent asked for or acquired. Now, it is impossible to hold “prior” consultation because the mining projects are functioning, in different stages.
Prior consent is crucial. It is well known that once companies enters indigenous areas that have for centuries been subject to violence and impoverishment, the companies are experts at dividing communities and families, turning brothers against sisters, husbands against wives, and establishing a climate of fear and violence - which is exactly what has happened in both San Miguel Ixtahuacan and El Estor, where Goldcorp and HudBay are operating.
Even in these contexts of violence and division, communities have clearly expressed their rejection of the mines through their customary law mechanisms. In San Miguel, over 20 Mayan Mam communities, the ones closest to the mine, have created community acts banning mining activities in their community territories. El Estor significant numbers of Mayan Qeqchi people and communities have signed petitions calling for the withdrawal of the mine, though that process was cut short when the head of the mine security force murdered an important leader – Adolfo Ich - of that process in September 2009.
As bleak as the reality of mining and impunity is, it is extremely important to demand compliance with international law, as so many Guatemala are literally risking their lives to do, a step in the slow march toward real global justice.

RE: IMPLEMENTATION OF ILO COMMITTEE OF EXPERTS’ RECOMMENDATIONS
The signatories of this letter work for the protection of human rights, and write to you regarding the situation of Indigenous Peoples in Guatemala. In particular, we write to request the Government’s compliance with the recommendations of the Committee of Experts of the International Labor Organization (ILO) regarding the protection of indigenous peoples affected by the authorization of mining activities, as well as compliance with the Constitutional Petition presented March 2, 2010 to the Secretary General of the Republic, which executes the recommendations of the Committee of Experts.
As you know, the Committee of Experts on the Application of Conventions and Recommendations of the International Labor Organization (ILO) of the United Nations, recently published its 2009 report.
The ILO Committee of Experts is an executive body that carries out independent technical reviews of the national practice of States’ compliance with international obligations that are part of ratified ILO conventions. In this undertaking, it evaluates the information sent by States, employees, and workers, creating recommendations to guarantee effective compliance with the conventions.
The Committee of Experts evaluated the case of San Juan Sacatepequez and the cement company working there. It also looked at the situation of land and salaries, coordinated actions and systematic participation of indigenous peoples, and the legislation on consultation and participation. In addition, it examined the situation of indigenous communities and lack of consultation regarding the mining license given to Montana Exploradora, S.A., subsidiary of Canadian mining company Goldcorp, Inc.
In the case of San Juan Sacatepequez, the Committee calls to the attention of the Government that indigenous peoples have the right to be consulted every time that actions that directly affect them are planned. This right is clearly established in the Convention regardless of whether it is reflected in any national legislation.
Additionally, the Committee notes that it is the Government that has the obligation to insure that indigenous peoples are consulted according to the Convention and not according to the practices of private enterprises.
Hence, the Committee urges the government to:
Align the existing legislation, such as the Mining Law, with Articles 6, 7 and 15 of the Convention
Adopt without delay all of the necessary means to engage in a constructive dialogue in good faith among all interested parties under the requirements provided in Article 6 of the Convention, which allows for seeking appropriate solutions to cases in a climate of mutual trust and respect, and taking into account the obligation of the State to guarantee the social, cultural and economic integrity of indigenous peoples according to the spirit of the Convention, and
The immediate suspension of the alleged activities while this dialogue is taking place; and an evaluation, with the participation of the interested populations, of the social, spiritual, cultural and environmental impacts of the planned activities, and of the extent to which the interests of indigenous peoples would be harmed, according to the provisions for Articles 7 and 15 of the Convention.
The Committee of Experts also urges the Government to take all necessary measures to ensure the establishment of appropriate mechanisms for consultation and participation as mentioned in the Convention, taking into consideration the Committee’s general observation in 2008 and providing detailed information in this regard. The Committee reminds the Government that it can request the technical assistance of the ILO and requests the Government to provide detailed information on the measures it intends to use to adopt and implement legislation on consultation. Please also provide information on the practical application of Article 26 of the Law of Urban and Rural Development Councils.
Regarding the mining licenses granted to Montana Exploradora – Goldcorp Inc. in San Marcos, the Committee has called to the attention of the government that the mining activities should be subject to previous consultation which is contemplated in Article 15, paragraph 2 of the Convention, together with the studies provided in Article 7, paragraph 3 of the Convention. As a result, the Committee, noting that the Government's report repeats the information previously presented, expressed its concern related to the lack of progress in this case subject to review and urges the Government to suspend the exploitation referred to until the studies outlined in Article 7, paragraph 3 of the Convention are completed, as well as the prior consultation outlined in article 15, paragraph 2 of the Convention.
We ask that detailed information be given in these regards. In addition, the Committee requests the Government to take the necessary means to clarify the incidents which led to the death of a citizen during a protest against the installation of a cylinder destined for the mine, and that it give detailed information thereon.
We await your positive response towards the effective protection of the human rights of Mayan communities in Guatemala and compliance with applicable international and national laws.

“Attempting to meet with Ontario Securities Commission and Toronto Stock Exchange might be a dead end. The OSC and TSX take the view that their job is to regulate stock markets for benefit of investors. Thus their activities should be limited to providing protection to investors from unfair, improper or fraudulent practices and to fostering fair and efficient capital markets and confidence in capital markets.
“It may be a good idea to request these meetings anyway. Indeed, it is a major issue that the TSX and OSC don’t see themselves as part of the problem when they clearly are.
